Following a divorce, the party with the lower income generally has a maintenance claim against the higher-earning party – at least in theory. In practice, matters often appear differently. In keeping with this motto, some maintenance recipients unjustly assert claims. A new job, a promotion and/or salary increase may not be disclosed, a cohabiting partnership resembling marriage may be concealed, and so forth. In rare cases, the failure to disclose may be accidental; more commonly, however, the individual is simply unwilling to accept a reduction in maintenance payments. Yet just as with maintenance obligations, concealing or misrepresenting actual income and living circumstances when claiming maintenance constitutes an offence and may result in a fine. While a liable party who withholds maintenance-relevant information must subsequently make outstanding payments, a recipient who has received maintenance unjustly may not only be required to repay the amounts but may even face complete withdrawal of maintenance entitlements by judicial decision.
